Privacy policy

1. General.

Protecting your privacy is very important to Buzz. This personal data protection policy covers personal information, irrespective of whether it is collected and stored in digital form, on paper, or in another comparable manner. The policy includes data entry, data storage, and processing of personal information falling within its scope. The policy can be found on www.buzzapp.is

 

2. Legislation on personal data protection.

Treatment of personal information is subject to the Act on the Protection of Privacy as current at any given time, as well as to the EEA Agreement. The Act covers, among other things, the processing, storage, and sharing of personal data.

 

3. Responsibility.

Buzz is responsible for the entry of personal data and for the handling of such data in its operations. Deilihagkerfi ehf. is authorised to utilise the personal data you provide to the company. You may contact us about our personal data protection policy or lodge a complaint about a possible violation of the Act on the Protection of Privacy by sending an e-mail to support@buzzapp.is.

 

4. Collection and use.

We collect and store a range of personal information about our customers, as listed below. We collect this information in order to be able to provide the service requested.

 

If you are our customer, we collect and store information relating to your business history. We gather this information so as to give you an overview of your business and to provide you with personalised service.

 

If you wish to be in contact with us and receive information from us on a regular basis (such as digital notifications or social media messages), you are asked to provide us with necessary information. This is entirely your choice.

 

Sometimes we ask you to provide us with additional information about you. This is information that we request because we think it will help us to provide you with better service. You are never required to provide such information unless you choose to.

 

When you use our web interface, we collect personal information through cookies, IP addresses, and other information about the device you use (i.e., type of hardware, operating system, etc.). You may choose whether you provide this information to us.

 

According to current personal data protection legislation, and on the basis of your consent, we and other service providers (that could represent the company) collect the following personal information about you:

 

Your name, national ID number (or date and year of birth), address, telephone number, and e-mail address.

 

Your credit card number, debit card number, bank account information, or other banking-related information.

 

Your business history with us, including how often and for how long you have rented a power bank from us, where you have collected it, and where you are located at any given time.

 

The communications you choose to have with us; i.e., e-mail, messages sent via web interface, recorded telephone calls, letters, or other communications.

 

Payment information — e.g., dates of payments received.

 

Information about your use of our app or website. This information includes when you downloaded the app, how long you use it, your estimated location while you are using it, information on the device you use to access the app, etc.

 

Mailing lists: If you subscribe to a Buzz mailing list, we will process information on your e-mail address and, as applicable, other information you provide to the company, such as your name and address. This processing is based on the customer’s consent, and the customer is authorised at any time to withdraw consent and unsubscribe from Buzz’s mailing lists.

 

Marketing: Buzz may use personal information that you provide to the company in order to send you special offers and advertisements based on that information. Such processing is based on the customer’s informed consent, which may be withdrawn.

 

Complaints and comments: If you send us a comment or complaint, Buzz will process your contact information, such as your name and e-mail address, and the substance of the complaint or comment that you have chosen to send.

 

Therefore, we may use your personal information in order to do the following:

 

Provide you with the service or products you have requested.

 

Process the requests or comments that you have sent us.

 

Offer you specified services on specified terms.

 

Inform you about new products and/or services.

 

Send you invoices for your business with us or charge you for purchase of goods and/or services.

 

Determine how you use our services so that we can improve our product and service offerings in the future.

 

Answer questions that you ask us.

 

5. Information sharing

We only share personal information with third parties pursuant to processing agreements that contain provisions on the treatment and security of personal data, unless we are required by law to do otherwise. If suspicions of fraudulent or unlawful conduct arise, we will share with the relevant parties any personal data that could be of significance in protecting our interests, your interests, and/or the interests of other customers.

 

If we should merge with another company, your personal information may be transferred to the new company.

 

6. Third parties

Our personal data protection policy does not cover collection or processing of your personal data by third parties where we have no control over or responsibility for the use, publication, or other handling of your personal data. We encourage you to acquaint yourself with the personal data protection policies of third parties, including hosts of websites that could make reference to or link to our website; software companies such as Facebook, Apple, Google, and Microsoft; and your chosen payment service provider.

 

7. Protection

Deilihagkerfi ehf. places strong emphasis on protecting all personal information and has therefore implemented an internal monitoring system that ensures that appropriate technological and organisational security measures are taken at all times.

 

We will notify you without undue delay in the event of a security breach that involves your personal data and could pose a significant risk to you. In this context, a security breach refers to a breach that leads to inadvertent or unlawful deletion of personal information, change in information, publication of it, or provision of unauthorised access to it.

 

It should be noted, however, that you are responsible for the personal information — such as your name, national ID number, and photograph — that you choose to share or send through a public forum such as TripAdvisor, chat lines, or Buzz social media pages.

 

Our websites use SSL certificates, which means that data transmission to and from the pages is encrypted. SSL certificates prevent third parties from gaining access to the data sent on the web, including, for instance, queries and service requests sent via the website.

 

Finally, Buzz wishes to point out that data transmission over the internet is never entirely secure. Therefore, you should notify us immediately if you believe that specific information you have provided to us is at risk.

 

8. Data storage

We will store your business history for up to four (4) years unless the law requires or authorises a longer storage period. If there is no longer a need for the information or if the law requires that it be deleted, your information will be made unidentifiable and/or will be deleted.

 

9. Your rights

You are entitled to request that Buzz provide you with information on the personal data about you in its possession, as well as on the processing and handling of your personal data.

 

In certain instances, you are entitled to have your personal information corrected or deleted, provided that there is no longer any reason for us to keep it.

 

We will consider your requests according to the above and will provide you with the information, correct it, or delete it (as applicable) within 40 days, subject to any limitations implied by the rights and freedoms of others, including business secrets and intellectual property rights. We will notify you and provide an explanation within one (1) month of receiving your request if there is a delay in processing or if it is not possible to comply with the request in full.

 

10. Amendments

This personal data protection policy is reviewed regularly and may therefore be subject to amendment. Therefore, you are advised to acquaint yourself with the policy on a regular basis, as amendments to it take effect upon publication on the company website: www.buzzapp.is

 

11. Measures to address possible violations

You are entitled to direct complaints due to possible violations of the Act on the Protection of Privacy, no. 90/2018, to the Data Protection Authority in accordance with the instructions contained in the Act.

 

This personal data protection policy was last adopted on 31 January 2022.

Terms and conditions

These Terms of Use (the Terms) apply to all products, services, and software that Buzz may provide, hereinafter referred to collectively as the Service. By using our Service, you imply consent to these Terms.

 

Buzz’s objective is to make it easier for individuals to rent power banks. We are continuously developing our Service in order to move closer to achieving this objective. At present, our Service includes power banks and related equipment, such as charging stations and charging equipment, hereinafter referred to as the Product(s). Our Service also includes our App, our website, other software, maintenance, staff, marketing materials, communications, and all materials shared with you.

 

Your user account

Setup. You must set up a user account that provides access to our software in order to use Buzz Products. In order to use a Product, you must have a valid credit or debit card. Payment information is transmitted through a third party; therefore, Buzz neither receives nor stores such information. A certified payment method is required if you wish to use Buzz’s Services. Other options for setting up user accounts and payment methods are available to certain users and companies; i.e., through Buzz’s corporate solutions. The information provided with the application for a user account shall be correct, satisfactory, and updated. When a user account is set up, the applicant must provide a mobile telephone number and will then receive a text message (SMS) in confirmation. Your user account is intended solely for you, and you are responsible for all use of Services falling under your account. If you suspect that someone has gained access to your personal information, you should contact Buzz immediately. Fraud. We take fraudulent conduct very seriously. If we suspect that you have provided incorrect information, we reserve the right to close your account until it has been verified that the information is indeed correct. During that period, you will have limited or no access to Buzz Services.

 

Use of the Service

You can use the Buzz App to locate, reserve, and rent Products.

 

Rules for use

You must be a registered user in order to be authorised to use Buzz Products, and you are prohibited from allowing others to use Buzz Products through your account.


 

You must be 18 years of age or older.

 

You must be competent to use Buzz Products, and you must have acquainted yourself with the proper use of the Product to which you have access. You must be physically able to use the Product. It is the responsibility of the registered user to decide whether conditions are such that it is unsafe to use Buzz Products.

 

You are prohibited from altering, adjusting, or tampering with the Product; furthermore, you are prohibited from damaging it and from attempting to obtain other users’ access to our Service.

 

There are a limited number of Products in circulation.

 

The Product must be charged at regular intervals. The condition of the battery depends on use. The Product can lose battery power for other reasons, such as weather conditions. Other factors can make a difference as well.

 

The registered user is responsible for determining the battery charge level of the rented Product and is responsible for estimating whether it will reach the intended destination in its current condition. Buzz makes every effort to ensure that Products are adequately charged for general use. However, we cannot estimate users’ charging time and therefore cannot be responsible for ensuring that users will reach their intended charge on the existing battery charge level.

 

We do our best to keep our Products in good condition, but because the equipment is in constant use, you should ensure that the Product is sufficiently safe before using it. This includes checking the following:

 

Is the general condition of the Product acceptable?

 

Are the cables in good condition?

 

Is the Product’s battery sufficiently charged?

 

Does the Product show signs of damage?

 

Does the Product require repair after previous usage?

 

It is always conceivable that something could have happened to the Product since it was last examined by Buzz. If something does not function correctly, you should always contact Buzz and let us know. In such instances, it is best to contact us at support@buzzapp.is, or to notify us through the Buzz App. If you notice that one or more of the above-mentioned safety features are malfunctioning before you begin using the Product, you should not use that Product. If you notice while you are using the Product that one or more of the above-mentioned safety features is malfunctioning, you should return the power bank to the station with the utmost care, and notify Buzz in the manner described above. If a registered owner does not contact Buzz under these circumstances, we could assume that the user is responsible for the condition of the Product and demand that the user pay for its repair.

 

Always remember: safety first!

 

If Buzz incurs expenses because of the actions of a registered user, Buzz reserves the right to demand that the user reimburse those expenses. It is prohibited to use Products for other activities than those for which they were designed. Registered owners are prohibited from sub-leasing our Products. Furthermore, it is prohibited to give use of Products as a prize in commercial activities (for example, as a lottery prize) without Buzz’s explicit permission. Naturally, it is prohibited to use our Products for the purpose of breaking the law.

 

Treat our Products as though they were your own!

 

Use. If all customers treat the Products with care and respect, there will be more Products in circulation and they will be in better condition. Unfortunately, our Products are not unbreakable, so we ask that you treat them with care.

 

Damage. Apart from conventional wear and tear, we expect registered users to return the Product in the same condition as it was when they rented it. If you damage the Product (deliberately or by accident), or if you do not return the Product in the expected manner and it is damaged as a result, you are liable for the costs resulting from the damage. Damage can be expensive, and repairing a single Product can cost up to ISK 10,000.00. The final amount is determined by the cost of repairing or replacing the Product. If the Product is not returned within 72 hours after it is rented, we reserve the right to collect the same fee from you; after that time, we assume that the Product has been lost or stolen.

 

Term of rental. It is possible to rent a Product for as long as it remains charged, but you must keep track of how long you have had the rented Product because we will not do it for you. You must be aware of how long you have had the rented Product in your possession and of the amount of battery power remaining at any given time.

 

Collecting the Product. If you do not return a Product to an appropriate location (i.e.,the charging station does not register that the power bank has been returned), and you ask us to collect the Product, we reserve the right to charge you a return fee that could range up to ISK 10,000.00. 

 

Accidents or damage to the Product. If the Product causes an accident, is involved in a fire, or is damaged; if its use causes physical injury; or if it is stolen or lost, you are responsible for notifying Buzz as soon as possible. If an accident causes physical injury or property damage, it is the registered user’s responsibility to call the police so that a police report can be filed.

 

Financial terms and conditions

Price and payment

You can rent access to Products for a per-minute fee according to our price list, which can be found in the App. Please note that we reserve the right to change the prices on our price list. Our prices include the applicable taxes and other fees. Payment of fees will be handled using the payment method you chose when you set up your user account with us. All payments are routed through a third-party payment portal. If you wish to lodge a protest against a payment charged to your account, you must notify us within 30 days of the end of the rental period. In order to resolve such matters, we need access to information on certain rentals, including the date, point of origination, and end point. In general, Buzz does not issue reimbursements for the use of its Products, but we do examine each case individually.

 

Bonus points

On certain occasions, or in connection with special events, we may award bonus points that can be used to rent our Products. Such an arrangement may be subject to special terms and conditions pertaining to each occasion/event. You should read those terms and conditions thoroughly before you decide to use your bonus points. We restrict the use of such points, however, so that registered owners may not merge bonus points for several occasions/events and use them all at once; instead, at any given time, users may only use points for a single occasion/event. Furthermore, you are prohibited from selling or giving away your bonus points. If you do so, we reserve the right to invalidate your points.

 

Fines and fees

When Services are used, the registered user must comply with the laws and rules governing the use of the Service. If you are fined for your use, if the Product is impounded or removed by the police, or if you are penalised in some other way while using the Product, you are solely responsible for it. By agreeing to these terms and conditions, you agree that we may charge you for this through the payment method specified in your user account; furthermore, we may need to contact you to gather further information.

 

Disputes and legal venue

If a dispute should arise between the parties, they shall attempt to resolve it themselves, but otherwise, the dispute shall be referred to the District Court of Reykjavík for resolution.
